TERMS OF USE FOR TREATING PHYSICIANS

These terms and conditions of use for Treating Physicians (“Treating Physician Terms of Use” or “Treating Physician Terms”) govern the use of Sideline Surgeons’ (“Sideline Surgeons,” “we,” “us,” or “our”) online interfaces and properties (e.g., websites and mobile applications) (collectively, the “Platform”) by Treating Physicians. The terms “you” and “your” as used in these Treating Physician Terms refers to you as the Treating Physician seeking to create an account or otherwise utilize Sideline Surgeons’ Platform. For purposes of clarity, these Treating Physician Terms are a supplement to, and not a replacement for, Sideline Surgeons’ general Terms of Use policy, to which Treating Physicians are also subject, and which is incorporated by reference herein.
“Treating Physicians” refers to physicians with the primary responsibility of care for patient athletes and who, at their own election or at the request of their patient athlete, seek professional medical consultations from the third party specialist physicians (“Consulting Physicians”) on Sideline Surgeons’ Platform. The Consulting Physicians offer professional medical consultations directly to Treating Physicians relative to the injury status and treatment options of patient athletes.
Your acceptance of, and compliance with, these Treating Physician Terms of Use is a condition to your use of the Site and Services. By clicking “accept”, you acknowledge that you have read, understand, and accept all terms and conditions contained within these Treating Physician Terms of Use, Sideline Surgeons’ general Terms of Use, and our Privacy Policy. If you do not agree to be bound by these terms, you are not authorized to access or use this Site or Services; promptly exit this Site.
Sideline Surgeons reserves the right to modify these Treating Physician Terms of Use at any time, effective upon posting. Any use of this Site after such changes will be deemed an acceptance of those changes. You agree to review the Treating Physician Terms of Use each time you access the Platform so that you may be aware of any changes to these Treating Physician Terms.
ELIGIBILITY TO USE THE SERVICES
In order to use the Services as a Treating Physician, you must:
- Be a physician licensed and in good standing in at least one U.S. jurisdiction which permits consultations with out-of-state physicians;
- Have established a proper physician-patient relationship with the patient who is the subject of the consultation to take place on the Platform;
- Have reviewed all relevant medical information and history pertaining to the patient; and
- not currently be excluded from participation in any Federal health care programs.
At the time you sign up for an Account or otherwise seek to use the Services, Sideline Surgeons will request information related to your credentials. Sideline Surgeons is under no obligation to verify the information you provide is accurate and up-to-date, but reserves the right to do so.
ACCESS TO SERVICES
Treating Physicians are able, but not required, to sign up for an account on Sideline Surgeons’ Platform (“Account”).
Use of Services by Accountholders
You may sign up for an Account on the Platform. Though creation of an Account is not required, some features are only available to Treating Physicians who are accountholders. For example, an Account is required in order for a Treating Physician to search through the lists and/or profiles of Consulting Physicians.
All consultations must occur through the Platform.
Use of Services by Non-Accountholders
Patients or their representatives (i.e., parents with respect to minor patients, agents, sports team representatives, etc.) may also create Accounts and search for Consulting Physicians. If your patient or their representative identifies a Consulting Physician with whom they wish for you to consult, the patient or their representative will be able to send you a link via email which grants you limited access to the Platform for purposes of reviewing the Consulting Physician’s availability and requesting a consultation time with the Consulting Physician. Before you request a consultation, you must provide certain information related to your professional qualifications (i.e., licensure #, NPI #), as well as information pertaining to your patient (i.e., date of birth, injury).
All consultations must occur through the Platform.
OBLIGATIONS OF TREATING PHYSICIANS
By registering for an Account or otherwise accessing Sideline Surgeons’ Platform to book and/or consult with Consulting Physicians on behalf of a patient, you agree to:
- Safeguard patient data, and adhere to HIPAA and other applicable restrictions in the use, maintenance, storage, and/or disclosure of a patient’s health information;
- Provide the Consulting Physician with relevant, complete, and accurate information (including coordinating with your patient when necessary) to enable the Consulting Physician to provide advice and recommendations to you;
- Follow all applicable professional rules and ethical guidelines; and
- Maintain a valid, up-to-date, and unrestricted license in all jurisdictions in which you practice.
You agree to immediately notify Sideline Surgeons if your status with respect to any of the above obligations changes.
You also acknowledge and agree that:
- Sideline Surgeons is not a healthcare provider, and does not provide any clinical services. Rather, Sideline Surgeons merely operates the Platform. Sideline Surgeons is not responsible for Consulting Physicians’ acts or omissions, or for any content of your communications with them. Sideline Surgeons is independent of the Consulting Physicians, and does not employ or otherwise exercise any control over the services provided by the Consulting Physicians.
- The Platform is not intended for use in medical emergencies.
- No telehealth services are provided via the Platform.
- The responsibility for the patient’s overall care remains with you as the treating provider. The Consulting Physician shall have no physician-patient relationship with your patient. You are ultimately responsible for any and all recommendations made to your patient relative to your patient’s injury, condition, diagnosis, and treatment. Sideline Surgeons is not responsible for any health-related outcomes stemming from decisions made by you and/or your patients, or any recommendations you make to your patient, regardless of whether such recommendation is based off of information or guidance stemming from the Consulting Physician.
- While Sideline Surgeons takes certain steps to ensure the Consulting Physicians are licensed and in good standing and not excluded from participation in Federal health care programs, Sideline Surgeons makes no representations or warranties with respect to these Consulting Physicians or the quality of services they provide. Further, Sideline Surgeons (a) does not employ, refer, recommend, or endorse any Consulting Physicians, (b) is not responsible for ensuring that information (including credentials) a Consulting Physician provides about himself or herself is accurate or up-to-date, (c) is not responsible for making sure that Consulting Physicians’ services are actually provided or are up to a certain standard of quality, and (d) does not receive any additional fees from Consulting Physicians for featuring them higher or in a better placement on lists through the Services.
- Though Sideline Surgeons encourages Consulting Physicians to use the Services responsibly, we have no control over, and cannot guarantee the availability of, any Consulting Physician at any particular time. We will not be liable for canceled or otherwise unfulfilled consultations, or any injury or loss resulting therefrom, or for any other injury or loss resulting or arising from, or related to, the use of the Services whatsoever.
If, after discussing with your patient, your patient wishes to schedule a surgery or other procedure with a Consulting Physician, you understand and agree that Sideline Surgeons’ involvement in any such arrangement ends when the requested consultation between the Consulting Physician and Treating Physician is completed and payment for such consultation is received. Any clinical services provided by a Consulting Physician to a Patient—whether in person or via telehealth—is outside the scope of Sideline Surgeons’ arrangement and Sideline Surgeons shall have no liability for any adverse outcomes stemming from such clinical services.
